1. Scope and Acceptance
This End User License Agreement ("EULA") is between you and Magique Technologies Limited ("Magique", "we", "our", or "us"), and governs your use of Tap'nSave software applications and related updates (collectively, the "App").
By downloading, installing, or using the App, you agree to this EULA, our Terms and Conditions, and our Privacy Policy.
2. License Grant
Subject to your compliance with this EULA, Magique grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for your personal, non-commercial use on devices you own or control.
3. License Restrictions
You may not:
- copy, modify, distribute, sell, lease, or sublicense the App;
- reverse engineer, decompile, or attempt to derive source code;
- remove copyright or proprietary notices;
- use the App for unlawful or fraudulent purposes;
- use automation or scripts to manipulate coupons, rewards, or accounts.
4. Updates and Changes
We may release updates, patches, and new versions. Certain features may require you to install the latest version to continue use. We may modify or discontinue features at any time, as permitted by applicable law.
5. Maintenance and Support
Magique is solely responsible for maintenance and support of the App. App stores are not responsible for maintenance or support unless required by their own terms.
6. Third-Party Services
The App may interact with third-party services, including merchant systems, analytics, cloud infrastructure, Apple App Store, and Google Play. Your use of third-party services may be subject to separate terms and privacy policies.
7. Termination
This license remains in effect until terminated by you or Magique. We may terminate or suspend the license immediately if you breach this EULA or applicable laws. Upon termination, you must stop using the App and delete all copies.
8. Warranty Disclaimer
To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Liability Limits
To the fullest extent allowed by law, Magique Technologies Limited is not liable for indirect, incidental, special, consequential, or punitive damages. Where liability cannot be excluded, our aggregate liability is limited to the greater of amounts paid by you to Magique in the last 12 months or USD $100.
10. Apple App Store Terms
- This EULA is between you and Magique, not Apple.
- The license granted is limited to use on Apple-branded products you own or control, as permitted by the App Store terms.
- Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for product claims, legal compliance claims, or third-party intellectual property claims related to the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), to the extent required by Apple policy.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
11. Google Play Terms
- You acknowledge this EULA is between you and Magique, not Google.
- Your use of the App must comply with Google Play terms and policies.
- Google is not responsible for support, maintenance, or warranty claims for the App.
- Refunds for purchases processed by Google Play may be subject to Google Play billing policies.
12. Export and Legal Compliance
You represent and warrant that you are not located in a country subject to embargoes or trade restrictions that prohibit use of the App, and that you are not on any government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws.
You must also comply with applicable third-party terms when using the App, including your mobile carrier and data service agreements.
13. General Legal Terms
This EULA is governed by the laws of England and Wales, unless mandatory local law provides otherwise. If any provision is held unenforceable, the remaining provisions will continue in full force.
